Mental Health and HSE Legislation – it happened

Mental health first aid has been around for a while now. Some claim it is the gold standard of mental health support in the workplace. May we can discuss that in another article. However, one thing is for certain, it is here to stay. As reported in THIS article by the BBC, making mental health first aid a legal requirement for businesses has been been proposed in parliament already. It seems, though, that the HSE (Health & Safety Executive) are taking the lead.

Changes to HSE Legislation Guidance

Recently the Health and Safety Executive updated their guidance in the area of first aid and mental health. Specifically they updated L74 – Guidance on The Health and Safety (First Aid) Regulations 1981. This now includes guidance on mental health in the workplace alongside the physical first aid guidance.

What has changed?

Below is a direct quote from the updated HSE guidance:

“It may also be helpful to have people trained to identify and understand mental ill health symptoms who are able to support someone who is experiencing a mental health issue. You may decide that someone with an FAW (First Aid at Work) or EFAW (Emergency First Aid at Work) qualification is already able to provide initial support and reassurance to a worker experiencing an acute mental health episode, but you should consider if any further training is required. You should be satisfied that they: Know how to access professional help if necessary and can act promptly, safely and effectively until that help is available

What does this mean for your business?

From reading the quote above it seems, initially, that you can chose whether your physical first aiders are able to provide support. However, it is the final lines that set it out more clearly. “You should be satisfied that they know how to access professional help if necessary and can act promptly, safely and effectively until that help is available”. Let’s be clear here; to be able to act promptly, safely and effectively people need to be adequately trained. 

It’s time for mental health first aid to be a part of your business.

For some smaller and medium sized businesses it’s not been a focus before. The financial costs and time lost for people going away for training has been a barrier.
